Family Legends Competition - Terms and Conditions

1. The competition will be organised and administered jointly by the BBC and Scottish Book Trust (the “Organisers”).
2. The BBC’s code of conduct for competitions applies to this competition. You can read more about it here: BBC Competitions Policy.
3. Entry to the competition is open to all UK residents * (including Channel Islands and the Isle of Man) except BBC employees or those of its affiliates or Scottish Book Trust employees and their close relatives or any person connected to the competition. Proof of age, identity and eligibility may be requested.
4. Entrants must be unpublished writers (unpublished writers means they must not have had a full-length work published (other than at the author's expense), broadcast, or performed commercially).
5. Entrants must write a short story about their family. For more information and ideas, please visit the website: http://www.scottishbooktrust.com/familylegends
6. Entries must be based on real events and must be no more than 1000 words. Entries must be typed and all stories must have a title.
7. By entering the competition, entrants warrant that they have obtained the permission of all living persons featured in the story. The Organisers accept no liability if entrants ignore these rules and entrants agree to fully indemnify the Organisers against any claims by any third party arising from any breach of these rules.
8. The competition opens at 11.00 am 11^th October 2010. Entries received before this date will not be considered.
9. Entries must be submitted either:

 a) online via the Scottish Book Trust website http://www.scottishbooktrust.com/familylegends

 OR

 b) by post to the following address: Scottish Book Trust, Sandeman House, Trunk’s Close, 55 High St, Edinburgh, EH1 1SR

10. The Organisers will only ever use personal details for the purposes of administering this competition. Please see the BBC Privacy Policy and Scottish Book Trust's Privacy Policy.

11.Closing time for entries is 11.00 am 31^st March 2011. Submissions received after this time will not be considered, so please do not wait until the last minute to upload or post your entry. Entries will not be returned so please remember to keep a copy. Unsuccessful entrants will not be contacted and no feedback on any entry will be provided.

12. Entrants can only enter individually. Only one entry per person is permitted. If you submit more than one entry, only the first entry received will be considered.

13. All entries must be the original work of the entrant and must not infringe the rights of any other party. The Organisers accept no liability if entrants ignore these rules and entrants agree to fully indemnify the Organisers against any claims by any third party arising from any breach of these rules.

14. Entries must not contain defamatory, obscene, offensive or any other unsuitable material. Entries must be suitable to be broadcast or published by the Organisers to audiences of all ages. Please see the BBC’s Editorial Guidelines for further information: BBC Editorial Guidelines

15. Entries must not contain anything which is calculated to bring the Organisers into disrepute.

16. Entrants retain the copyright in their entries but grant to the BBC a non-exclusive licence to broadcast their entry across all media, as well as use it on any online platforms.  Entrants also grant Scottish Book Trust a non-exclusive licence to use their entry for publication in printed and digital format (including on  Scottish Book Trust website) as well as for any promotional purpose.

17. Entrants permit the BBC and Scottish Book Trust to edit or change entries in any way it may in its sole discretion consider necessary for the purposes of use in the competition and the uses set out in clause 16 above.

18. By entering the competition, entrants warrant that they have legal capacity to enter the competition and agree to be bound by these Terms and Conditions.

19. A selection of entries may be broadcast on radio by the BBC and used online by the Organisers throughout the competition. A selection of entrants may also be interviewed by the BBC and these interviews may also be broadcast on radio and used online. This will not be a part of, or have any influence on, the judging process. The names of each entrant whose entry is broadcast, used on-line or published will be made public. Entrants must agree to take part in any post-competition publicity if required.

20. Entries will be judged on the following criteria:

• The story’s distinctiveness and originality,
• Whether the story develops and reads well, and
• Whether the story engages the reader emotionally.

21. Entries will be judged through the following process:

Stage One

A team from Scottish Book Trust will review all entries and create a long-list of entries based on the criteria set out above.

Stage Two

A panel of judges comprising of 2 senior staff from Scottish Book Trust and 2 senior staff from BBC Radio Scotland will review all shortlisted entries and select 50 - 80 stories to be published in a book called Family Legends, based on the criteria set out above. The judging panel will also choose 5 stories, from the 50 – 80 selected, to be broadcast on Radio Scotland, based on the additional criterion of how well the story will read on the radio.

22. The winners will be contacted by a member of the BBC or Scottish Book Trust team during the week commencing 18 April 2011. If the winner cannot be contacted after reasonable attempts have been made to do so, the Organisers reserve the right to offer the prize to the next best entry. If the winner is under 18 and cannot provide consent of a parent or guardian, the story cannot be published or broadcast and the prize will be offered to the next best entry.

23. For the 50 – 80 selected stories the prize will consist of the stories being published in a book to be organised by Scottish Book Trust. In addition, the top 5 stories will also be read-out on-air on BBC Scotland. The prize is as stated and cannot be deferred or transferred. There will be no cash alternatives. There will be no payment for any story that is broadcast or published. Any profits made from the book published will be donated to charity.

24. The Organisers’ decision is final and no correspondence will be entered into.

25. The Organisers reserve the right to disqualify any entry which breaches any of these Terms and Conditions or to withhold or withdraw a prize if in its opinion entries do not reach the required standard.

26. The Organisers reserve the right to amend these Terms and Conditions or cancel this competition at any stage, if deemed necessary in its opinion, and if circumstances arise outside its control.   In this event, a notice will be posted on the BBC Radio Scotland and Scottish Book Trust websites.

27. The Organisers, their sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any server, Internet access, system, the post or otherwise which may result in any entry being lost or not properly registered or recorded. Proof of sending is not proof of receipt.

28. These Terms and Conditions are governed by the laws of Scotland.

*NB Although entries to the radio broadcast part of the competition are restricted to UK residents, anyone who would like to write stories for the project is welcome to do so and will be considered for the book publication selection.
